Architectural Modification Request (AMR) Process

Question: What if I do not submit an AMR for an improvement?

Answer: If you do not submit an application and the improvement is in violation of the Master Development Design Guidelines or the Declaration of Covenants, Conditions and Restrictions, you may be required to remove the improvement at your expense and pay for any legal fees the Board has incurred. Both of these documents can be viewed at the Seven Oaks Web Site (www.sopoa.com) under “documents”.

Question: How do I know what the standards are for my improvement?

Answer: All of the SOPOA documents are now on the web site in a searchable format. You will need to check each the Master Development Guidelines and the Declaration of Covenants, Conditions and Restrictions. Both of these documents can be viewed at the Seven Oaks Web Site (www.sopoa.com) under “documents”.

Question: What if I still have a question, comment or problem concerning my application?

Answer: For general questions, suggestions, or comments, please feel free to e-mail the Communications Director. For more specific application questions, e-mail the DRC Chairman. You can email them by going to the Seven Oaks Web Site (www.sopoa.com) and clicking on “Contact SOPOA”.

Question: Is a landscaping plan required for all applications.

Answer: Applications for pools, screen enclosures, fencing, room additions, replacement or modification to existing landscaping, or new landscaping initiatives need to have plans submitted.

Question: How long does the approval process take and when will I have an answer?

Answer: The DRC meets once a month, so it may take up to 45 days to receive your answer.

Question: When does the Design Review Committe (DRC)meet?

Answer: The DRC meets on the 3rd Monday of every month at 7pm at the Clubhouse.

Question: How long will it be before I hear back about my application?

Answer: You will receive an official response in the mail within about 7 days after the meeting giving additional allowance for holidays.

Question: Can I attend the DRC meeting?

Answer: Yes, the meetings are open to all residents. Some residents attend so that they can ask the DRC questions at the end of the meeting regarding an application that they are in the process of completing.

Question: Where can I find the documents I need?

Answer: All of the documents you need are on the website. Under the Documents section you will find the AMR Request Form along with a sample submittal for a Pool, Screen, and Fence. You can also find the Master Development Design Guidelines as well as the Declaration of Covenants, Conditions and Restrictions in this section.

Covenant Enforcement

Question: Why have Covenants?

Answer: The purpose of the covenants is to enhance and protect the value, desirability and attractiveness of the community.

Question: What are some common Covenant violations?

Answer: Some common violations are weeds in the yard, yards not mowed and edged, palm trees need trimming, dirt and mildew on driveway, dead plants and trees, trash containers left out in view on non pick up days, dirt and mildew on house, flower beds needing mulch, garage doors left open, and brown grass.

Question: What happens if a violation is observed?

Answer: A friendly reminder is sent outlining the violation. If the violation is not addressed, a second and third letter will be sent with possible fines being levied for non compliance.

Assessments

Question: How many lots are there in Seven Oaks that pay into the SOPOA?

Answer: There are 1,831 lots in 23 neighborhoods that have been assessed and that are billed their yearly assessment dues.

Question: How much do we pay our Property Management Company?

Answer: SOPOA pays the Property Management Company, Rampart Properties, $1.00 per lot per month plus a minimum of $1,800 per month. In addition, SOPOA pays for administrative expenses that they incur. The Management fee is increased each year based on the Consumer Price Index (C.P.I.) subject to a maximum increase of five (5%) percent.

Question: When is the assessment due?

Answer: The Property Manager sends the first assessment notice around September 1st with a due date of October 1st.

Question: What happens if the assessment is not paid?

Answer: The Property Manager will send a late notice and the homeowner will be charged a $25.00 late fee. If the assessment is still not paid by the due date in the late notice, the homeowner will be sent a Pre-Lien letter and will be charged an additional $47.00. If not paid within 45 days, the account will be turned over to the attorney to file a Claim of Lien. The homeowner will then be responsible for hundreds of dollars in legal fees in addition to the assessment, $25.00 late fee, and $47.00 Pre-Lien fee.

Question: How is the assessment fee determined?

Answer: The Property Manager adds up the projected cost for cost such as management fee, administrative cost, insurance, accounting, web site, forced mowing, and attorney. These projected costs are divided among the 1,831 lot owners to obtain the assessment for the next year. The homeowners in the gated neighborhoods will have an additional assessment to pay for the maintenance of the agate. The projected cost of the gate maintenance contract and repairs not covered by the contract are divided among the 1,268 lot owners in gated neighborhoods.

Seven Oaks Management

Question: Crown? CDD? SOPOA Board? Neighborhood HOAs? Residents Council? What do each of these do, I'm confused !!

Answer:
Crown Community Development: This company is the developer for Seven Oaks. They use subcontractors to survey and build infrastructure (roads, power lines, sewer, etc.). When the neighborhoods are platted (divided into lots), they sell the lots to the builders such as McCar, Mercedes, Arthur Rutenberg, Avalon, Standard Pacific, etc) who then sell the lots to individuals.

Community Development District (CDD) I and II Boards: These boards are currently resident controlled. They are responsible for the common areas such as streets, parks, and The Club at Seven Oaks. CDD I is all of Seven Oaks south of the power lines. CDD II is all of Seven Oaks north of the power lines to Eagleston Blvd. The CDD Boards have contracted with Rizzetta & Company (Scott Brizendine) to be their property manager. Homeowners pay annual CDD bond and O&M assessments with their Pasco County tax bill. The CDD bond yearly payment, which remains the same each year, has to be paid for 30 years unless the homeowners pay the balance due. The O&M assessment varies each year with changes in operating costs.

Seven Oaks Property Owners' Association (SOPOA) Board: The Board members consist of seven homeowners in Seven Oaks. The SOPOA Board is currently responsible for 21 neighborhoods in Seven Oaks. Although Silverleaf (townhomes), Windsor Club (Apartments/Condos), and Colonial Grand (Apartments) belong to CDD I, they will not belong to SOPOA. When the four remaining neighborhoods (Blue Heron, Stonecreek, Watermark, and Parcels C-1A/C-1B) have been platted, they will also belong to SOPOA, which will make a total of 25 neighborhoods. While the CDD Boards are responsible for the common areas, the SOPOA Board is responsible for enforcing the community's Declaration of Covenants, Conditions and Restrictions with respect to the lots/homes. It operates according to Chapter 720 of the Florida Statutes. The SOPOA Board has contracted with Rampart Properties to be their property manager. Their responsibilities include collecting assessments, processing Architectural Modification Requests (AMR), and Covenants enforcement. To collect assessments, Rampart will send the homeowners an annual assessment ($62 for non-gated and $95 for gated for October 1, 2007 to September 30, 2008) about September 1st of each year that is due October 1st. As for processing AMRs, Rampart insures the AMRs are complete and then sends them to the Design Review Committee (DRC), which consists of (currently) 5 homeowners. The DRC will approve or deny the AMR that contains any changes to the outside of the home or the lot landscaping. This would include painting a home a different color, building or screening a lanai/pool, installing a fence etc. The other main function of the Property Manager is to conduct weekly inspections to insure that all lots/homes are in compliance with the Declaration of Covenants, Conditions and Restrictions as well as the Master and Neighborhood Design Guidelines.

Neighborhood Homeowner Associations (HOA): At Seven Oaks, there are two townhouse neighborhoods (Lakeside and Silverleaf) and three villa neighborhoods (Villas at Edenfield, Villas of Deer Run, and Villas of Willow Creek) that have a separate HOA. The homeowners in these five neighborhoods belong to their respective HOA and must abide by the Declaration of Covenants, Conditions and Restrictions. This means that the residents in all of them except for Silverleaf, which does not belong to SOPOA, must follow the guidelines from two Associations.

The Seven Oaks Residents Council works closely with the Community Development District (CDD) I / II Boards and the SOPOA Board. Where the CDD and SOPOA Boards are official, the Residents Council is not an official organization. The Council consists of a representative from each of the neighborhoods at Seven Oaks. The purpose of the Residents Council is to work with the developer (Crown), CDD Boards, SOPOA Board, Pasco County, etc to represent the positions of the majority of homeowners at Seven Oaks.
